1. Status

These terms apply to persons who register for Aidana Personal, Free, or other individual subscriptions that are not intended for business use.

This document is designed as a standalone terms document for consumers and individual users.

2. Scope

These terms apply to individual users and consumers entering into an agreement for Aidana Personal, Free, or similar personal subscriptions.

If you are a legal entity, use the service on behalf of a business, or purchase the service as part of commercial activity, the Terms of Service — Business shall apply instead.

Unless Frostgate expressly states otherwise for a specific region, these terms are primarily intended for consumers in Norway and the EEA.

3. Account and Access

You are responsible for ensuring that the information you provide when registering is accurate and up to date.

You must protect passwords, login credentials, and other access information, and you are responsible for activity carried out through your account unless mandatory law requires otherwise.

Frostgate may require you to verify your identity, email address, or other information where necessary for secure operations or handling misuse.

4. Use License

Frostgate grants you a limited, non-exclusive, non-transferable, and revocable license to use the Aidana service in accordance with these terms.

Use of the service does not grant ownership of the Aidana platform, model configurations, code, design, documentation, or other underlying technology.

You retain rights to content that you upload or enter yourself, subject to the processing necessary to deliver the service.

5. Prices, Payment, Renewal, and Right of Withdrawal

For paid subscriptions, the prices and payment terms stated at the time of order shall apply.

Subscriptions continue until terminated and renew automatically for a new subscription period unless you cancel before the next renewal date. Notice, cancellation, and renewal shall be handled in a manner consistent with applicable consumer law.

Price changes to your detriment may only take effect where the agreement permits such changes and you have been notified in reasonable time on a durable medium. If the price change triggers a right of free termination or other mandatory protection under non-waivable law, statutory rules shall prevail over these terms.

You may cancel your subscription at any time. The cancellation takes effect at the end of the period already paid for, unless mandatory law gives you a right to terminate earlier.

If you purchase the service as a consumer through distance selling, you may have a right of withdrawal under applicable law. If you expressly request that delivery of a paid digital service starts before the withdrawal period has expired, Frostgate shall obtain such express prior consent and clearly inform you of any loss or limitation of the right of withdrawal where required by law. Confirmation of the agreement and relevant withdrawal information shall be provided on a durable medium to the extent required by applicable law.

Refunds are normally not granted for subscription periods already commenced or paid for, unless this follows from mandatory law, Frostgate's breach, or an express promise made at the time of purchase.

6. User Obligations

You are responsible for all content you upload, enter, or otherwise submit to the service.

You must not use the service for unlawful, harmful, harassing, or clearly unethical purposes.

You are responsible for assessing whether it is appropriate to submit personal data, confidential information, or other sensitive material to the service.

7. AI-Specific Disclaimers

Aidana gives no guarantee that AI output is accurate, complete, up to date, or suitable for your purpose.

AI may generate errors, inaccuracies, bias, or misleading wording. You must therefore always review and verify output before using, publishing, sharing, or relying on it for decision-making.

Aidana does not provide legal, medical, financial, or other professional advice. The service is a support tool, not a substitute for human judgment.

If the service uses web search or other external sources, output may be affected by errors, omissions, or manipulative information in such sources. Frostgate is not responsible for content published by independent third parties.

Frostgate may change the models, providers, features, and underlying technology used in the service. This may affect results over time.

8. Acceptable Use

You must not use the service to:

  • violate the law, third-party rights, or the privacy of others
  • send, store, or publish unlawful, discriminatory, hateful, threatening, or harmful content
  • carry out unauthorized access, hacking, scraping, reverse engineering, or attempts to bypass security mechanisms
  • transfer malware, spam, or other unwanted or harmful communications
  • use the service in a manner that may harm stability, availability, or security

Frostgate may restrict, suspend, or terminate access in the event of material or repeated breaches of these rules.

9. Liability and Consumer Remedies

If the service does not function as agreed, or if other defects exist, you may have rights under mandatory consumer law, including the right to correction, price reduction, termination, or other statutory remedies where the applicable conditions are met.

Frostgate shall not be liable for loss caused by your own use of AI output without reasonable review and assessment.

To the extent permitted by law, Frostgate's total liability to you is limited to the amount you actually paid for the Aidana service during the twelve (12) months before the claim arose. For free users, no contractual liability applies beyond what follows from mandatory law.

Frostgate is not liable for indirect loss, consequential damage, loss of income, loss of data, or loss of business opportunity to the extent permitted by applicable law and not contrary to non-waivable consumer protection.

10. Privacy

Aidana's Privacy Notice applies to the processing of personal data.

Consumers should not assume that the DPA applies directly to individual subscriptions. Data processing agreements are normally relevant for business customers and controller-processor relationships.

11. Termination, Suspension, and End of Service

You may close your account and cancel your subscription in accordance with Section 5.

Frostgate may suspend or terminate your access in the event of material breach, unlawful use, non-payment, security risk, or other use that may reasonably threaten operation of the service or other users.

Upon termination, access to your account and content may be closed after a reasonable transition period, subject to legally required retention, documented security needs, and what otherwise follows from the Privacy Notice.

12. Consumer Rights and Disputes

These terms do not limit non-waivable consumer rights in your home jurisdiction.

For consumers in Norway and the EEA, these terms shall in principle be interpreted in accordance with Norwegian law, but local consumer protection laws prevail if they provide stronger protection.

For consumers outside Norway and the EEA, mandatory local consumer law may apply. Frostgate may publish separate regional personal terms or addenda for such markets.

If a specific dispute resolution mechanism is prohibited or unreasonable under applicable law, the local court or other lawful dispute mechanism shall take priority.

13. Changes to the Terms

Frostgate may update these terms with reasonable notice.

For material changes (including price increases, changes in automatic renewal, termination rules, limitations of liability, or your user rights):

Frostgate shall give you clear notice at the email address linked to your account or through another durable medium, at least 30 days before the change takes effect.

If you do not accept the material change, you may terminate the agreement without penalty before the change takes effect, to the extent required by applicable consumer law.

Continued use after the change takes effect will only be treated as acceptance to the extent permitted by applicable law and after you have had a reasonable opportunity to review the updated terms.

Where applicable law or Frostgate's product flow requires renewed active acceptance for specific changes, Frostgate may require you to re-accept the updated terms before continued use of the affected paid service or feature.

For minor, non-material changes (bug fixes, UI updates, security measures), Frostgate may implement changes with shorter notice.

15. Entire Agreement and Severability

These terms constitute the entire agreement between you and Frostgate regarding use of Aidana Personal, together with any pricing information and the Privacy Notice expressly incorporated at the time of purchase or registration.

If any provision of these terms is found invalid or unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.
